China to Accelerate Trademark Registration
China's State Administration for Industry and Commerce has announced a plan to accelerate trademark registration. It will open its trademark database for public use, encourage electronic filing, move registration to regional offices, and cut the issuance of a notice of acceptance from six to three months.
Does Tasty Made Infringe Tasty Burger
The burger chain Tasty Burger has sent a cease and desist letter to Chipolte, asserting that Chipolte's new "Tasty Made" burger brand infringed the "Tasty Burger" mark. Chipolte just filed for its "Tasty Made" marks, and Tasty Burger is sure to oppose if the Tasty Made mark isn't rejected for likelihood of confusion.
TTAB Finds "Miss G-String" Doesn't Cause Confusion
On the lighter side, the Trademark Trial and Appeal Board found that the mark "Miss G-String International" would not be confused with "Miss Nude International." While a consumer might not be able to distinguish between the two "beauty pageants," there would be no likelihood of confusion their marks.
Craigslist Sues CraigPay, Arguing Famous Mark
Craigslist has sued the payment service CraigPay for trademark infringement. CraigPay provides payment options for Craigslist. Craigslist is arguing that it is a famous brand, and therefore CraigPay's slightly different mark is infringing.
Bootlegger's Brewery Sues Over Bayou Bootlegger
Bootlegger's Brewery has sued Abita Brewing for trademark infringement over Abita' "Bayou Bootlegger" hard root beer. The mark "Bootlegger's Brewery" is registered in class 032 for beer and 043 for taproom services. It will be interesting to see if likelihood of confusion is found a hard root beer.
