Uber Promotions Limit Use of UberEvents

Uber Technologies, the ride hailing company, as been stopped, at least temporarily, from using its UberEvents mark in Gainsville, Florida. A local limo company, Uber Promotions, was using the Uber mark in Gainsville before Uber Technologies registration. A judge stopped the use of UberEvents because of the likelihood of confusion.

Fox News Settles 9/11 Copyright Infringement Case

Fox News settled the copyright infringement suit for its use of the iconic "Raising the Flag at Ground Zero” 9/11 photo just hours before the case went to trial. Because of high statutory damages, copyright infringement cases usually settle before trial.

Kit Kat Shape Can't Be Trademarked

A UK court ruled that Nestle can't trademark the design of its Kit Kat candybar. The court found that the design was not distinctive. The court received guidance from the Court of Justice of the European Union.

Commerce Recommends Copyright Law Changes

The US Commerce Department has recommended changes to copyright law. The main recommendation is for reforming the high statutory damages for copyright infringement. The recommendations also address first sale issues and remixing.

The 11th Circuit affirmed a district court ruling that the use of the likeness and name of Rosa Parks in commercial products is protected by the First Amendment and does not violate the her right of publicity.
